How can I report a user sharing illegal content ?

The company D1FFER, publisher of the software Gigatribe, allows users to exchange files directly, without them transiting through a server. It is important to emphasize that the content shared via the software is done directly by the users, acting autonomously and under their full responsibility. The company D1FFER cannot in any case be held responsible for the creation, hosting or referencing of said content.

Furthermore, the company D1FFER wishes to specify that it does not promote the Gigatribe software on any basis related to the provision of protected works. Moreover, it informs its users, several times and places on its site, of the formal prohibition on sharing illegal or copyrighted content. Although the Gigatribe software is perfectly legal, its use is subject to strict compliance with the End User Licence Agreement (EULA).

In the event of non-compliance with the EULA, and in particular Article 7.4 relating to lawfull purposes, the company D1FFER reserves the right to take sanctions against the offending users, which may go as far as the permanent deletion of their account. However, the company D1FFER recalls that the proof of the infringement of the EULA must be established by an french authority which must then inform the company D1FFER of the identity of the offending user.

In extreme cases, such as the sharing of odious content (pedopornography, attacks on persons, etc.), users are invited to contact the police services or to inform the company D1FFER at the address judiciaire@gigatribe.com, which will forward the complaint to the competent authorities. It should be noted, however, that the company D1FFER does not have the necessary technical means to verify the veracity of the report or to characterize the reported content.
